What Is Title II of the ADA & Why Does It Matter?

1977, disability activists protesting in Washington to get Section 504 of the Rehabilitation Act of 1973 signed into law

Title II of the Americans with Disabilities Act (ADA) requires state and local governments to ensure their websites, mobile apps, and digital content are accessible to people with disabilities.

In April 2024, the Department of Justice (DOJ) finalized new digital accessibility rules, setting clear requirements for web and mobile accessibility compliance based on the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA.

Who Needs to Comply?

  • State & local governments (municipalities, counties, state agencies)
  • Public schools, universities & libraries
  • Transit agencies, courts & law enforcement
  • Public-facing digital services & apps

Why Compliance Matters

  • Avoid legal risk – The DOJ is actively enforcing accessibility requirements
  • Improve citizen engagement – Ensure digital services work for everyone
  • Build a sustainable accessibility program – Reduce costly remediation efforts in the future
